Release of Liability, Waiver of Claims, and Assumption of Risks Agreement

By purchasing a court booking, utilizing the facilities at Bay 6, 775 Sutherland Dr, Brooks, AB, or using the AceBall™ Interactive System and related equipment (including automated ball machines), you (the "Participant") agree to the following terms:

1. ASSUMPTION OF RISK

I am aware that participating in pickleball, interactive sports, and using automated sporting equipment (including but not limited to ball machines and interactive projectors) involves inherent risks, including but not limited to: physical injury, slip and falls, getting struck by balls or equipment, and property damage. I freely accept and fully assume all such risks.

2. UNMANNED FACILITY

I understand that Ace Brooks Corp operates as a partially or fully unmanned facility. I acknowledge that staff may not be present on-site during my booking. I assume full responsibility for my own safety and the safety of any minors accompanying me.

3. RELEASE OF LIABILITY

I hereby waive any and all claims that I have or may have in the future against Ace Brooks Corp, its owners, directors, officers, employees, agents, and landlords (collectively the "Releasees"), and release them from any and liability for any loss, damage, expense, or injury that I may suffer as a result of my use of the facility and equipment, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE OR BREACH OF CONTRACT.

4. FACILITY RULES

I agree to follow all posted rules, leave the facility promptly at the end of my booked time, and understand that power and lighting may automatically shut off at the end of my session.
